The state of Montana has restrictions on what can be reported in a background screening report beyond what the Fair Credit Reporting Act (FCRA) dictates.

RestrictionExplanation
Use of Social Media Password InformationHB 343, signed by the Governor on April 23, 2015, prohibits request of online passwords as a condition of hiring or employment. An employer or employer's agent may not require or request an employee or an applicant to disclose a user name or password for the purpose of allowing the employer or employer's agent to access a personal social media account.
